Terms of Service

These Terms of Service (“Terms”) govern access to and use of MG OS, a business operating system for studios and service businesses (“MG OS”, “we”, “us”, “the platform”), provided by MG Photography. By accessing or using MG OS, a studio and its authorized users agree to these Terms. These Terms have not been reviewed by outside legal counsel; they describe how the platform is intended to be used in plain language.

1. Use of the platform

MG OS is a software platform that helps studios and service businesses manage marketing, sales and lead management, customer management, project and event operations, accounts, customer service, and related business communication, from a single platform.

2. User accounts

Each person who uses MG OS does so under an individual account, issued and managed by the studio they work for. Users are responsible for keeping their own login credentials confidential and for activity carried out under their account.

3. Studio accounts

A studio (“Customer”) registers for MG OS as its own isolated account. The Customer is responsible for the accuracy of its business information and for how it configures and uses the platform.

4. Authorized users

A Customer decides which individuals may access MG OS on its behalf, and what role each is assigned. The Customer is responsible for the actions of the users it authorizes, including anyone it later removes access for but who retained credentials improperly.

5. Acceptable use

A Customer using MG OS agrees to:

  • Use the platform, and any connected account, only for legitimate business purposes with its own leads and customers.
  • Obtain any consents required by law before contacting individuals through connected communication channels.
  • Comply with applicable law and with the policies of any third-party platform it connects to MG OS, including WhatsApp and Meta.
  • Not use MG OS to send unsolicited, unlawful, or abusive communications.

6. Integrations

MG OS allows a Customer to connect its own external accounts, such as a WhatsApp Business account, to use related features. The Customer owns and is responsible for its own connected accounts, including compliance with that platform's own terms. MG OS provides the software functionality that enables these features and does not claim ownership of, or independent rights to, a Customer's connected accounts.

7. User responsibilities

Users are expected to use MG OS honestly, to safeguard their own account credentials, and to use any connected communication channel only for the purposes the Customer has authorized.

8. Intellectual property

MG OS, including its software, design, and underlying technology, is owned by MG Photography. These Terms do not transfer any ownership in MG OS to a Customer or user. As between MG OS and a Customer, the Customer retains ownership of its own business data entered into or processed through the platform.

9. Service availability

MG OS is under active development. Features may be added, changed, or improved over time. We aim to provide reliable access to the platform but do not guarantee uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, MG OS and MG Photography are not liable for indirect, incidental, or consequential damages arising from use of the platform, except where such limitation is not permitted by applicable law.

11. Termination

We may suspend or terminate access to MG OS for a Customer that violates these Terms or misuses the platform or a connected communication channel. A Customer may stop using MG OS and disconnect its connected accounts at any time.

12. Governing provisions

These Terms are governed by applicable law in the jurisdiction where MG Photography operates. If any provision is found unenforceable, the remaining provisions continue to apply.

13. Changes to these Terms

As MG OS continues to be developed, these Terms may be updated to reflect changes to the platform or applicable requirements. Material changes will be reflected by updating the date above.
